Why a bulldog

Bred to hold, not to bite

The breed was not built for speed or for a first strike. It was built low, wide and heavy-jawed for one job: to take a grip and keep it while everything above it tried to shake loose. That is what the crest on this page stands for, and it is why the poster on the home page shows the dog with a chain in its teeth rather than a bone.

That is the whole argument for putting one on the door. A merchant cash advance funder's collection model does not depend on being right. It depends on the merchant running out of attention, money or nerve first: on the restraint staying on long enough, the default judgment going unopposed, the UCC filing sitting unchallenged because nobody sent the demand letter that starts the twenty-day clock.

The defense is not clever. It is a lawyer who files the order to show cause this week rather than next month, answers before the deadline instead of after it, and is still on the docket at motion four when the funder assumed everyone would be gone. Grip, not teeth.

Plenty of legal websites in this space are lead-brokerage operations that sell your intake to whichever firm is buying that week. This is not one of them. MCA Bulldog is a practice name used by Usher Law Group, P.C. When you retain us, you retain the firm. The engagement letter names the firm. The notice of appearance names the firm. The attorney reading your funding agreement is the attorney whose name is on the door.

Mikhail Usher, Esq., founding and managing attorney

Mr. Usher earned a bachelor's degree in political science from Brooklyn College and his law degree from St. Thomas University School of Law in Miami, where he served as a senator in the Student Bar Association, competed on the school's national-champion mock trial team, and graduated with high honors. He clerked for the Hon. Amy Steele Donner in Dade County, Florida.

After admission in New York and New Jersey he practiced immigration, criminal, employment and consumer-protection law at a Brooklyn firm, where he built out the criminal division, and later passed the Florida bar. He opened Usher Law Group, P.C. roughly three years afterward and has led it since. He has been recognized by Super Lawyers as a Rising Star and subsequently as a Super Lawyer, and is a member of the American Immigration Lawyers Association, the American Bar Association, the New York County Lawyers Association, and the New York and New Jersey State Bar Associations.

He is admitted in New York, New Jersey and Florida with federal admissions including the Eastern and Southern Districts of New York, the District of New Jersey, the Middle and Southern Districts of Florida, and the First, Second and Third Circuits. He leads the firm's commercial litigation and MCA defense work.

He speaks Russian and Spanish in addition to English. That is worth stating plainly rather than burying: a Sheepshead Bay merchant with a restrained operating account should be able to discuss a reconciliation covenant and a CPLR 5240 application in the language they actually think in, with the lawyer handling the file, not through an interpreter line staffed by someone who has never read a UCC-1.

What "MCA-focused" means and does not mean

We are a litigation firm with a concentrated MCA practice

We will not tell you that 100% of what we do is merchant cash advance defense, because it is not true. Usher Law Group, P.C. is a general litigation firm whose work also includes commercial and civil litigation, immigration and deportation defense, criminal defense, family law, employment and wage-and-hour matters, and consumer protection.

What is true is that MCA defense is a concentrated, recurring part of the docket: the same funders, the same drafting counsel, the same clause library, the same courts. That repetition is the actual advantage, and it is a more useful claim than a percentage nobody can verify.

How we charge

Flat fee where the scope can honestly be defined. A motion to vacate a confession of judgment, an answer with affirmative defenses and counterclaims, a UCC termination demand campaign: these have knowable boundaries, and we price them that way.

Hourly where the scope genuinely cannot be defined. Contested litigation with discovery, depositions and an uncertain end date does not fit a flat fee, and quoting one anyway just means the fee gets revisited later under worse circumstances.

Either way, the number and what it covers appear in the engagement letter before you commit. The case review that produces the number is free and carries no obligation.
